Court Curbs Police, FRSC Powers on Motor Insurance Fines in Landmark Ruling

A Federal High Court in Abuja has ruled that the Nigeria Police Force and the Federal Road Safety Corps cannot impose fines on motorists for third-party motor insurance violations without a valid court order.

Delivering judgment on the matter, Justice Hauwa Yilwa held that such penalties must follow due judicial process, effectively limiting the enforcement powers of the agencies in this regard.

The ruling stems from a suit filed by Deji Adeyanju against the inspector-general of police, the attorney-general of the federation, and the FRSC. The case, marked FHC/ABJ/CS/291/2025, sought legal clarity on whether law enforcement bodies could independently enforce compliance with motor vehicle insurance requirements through on-the-spot fines.

In its decision, the court emphasised the need to uphold the rule of law, stating that enforcement actions must align with constitutional provisions and established legal procedures.

There has been no immediate reaction from the affected agencies following the judgment.
