Biafra Agitation: Kanu Wanted Kogi, Benue Inclusion, DSS Operative Tells Court

A Department of State Services (DSS) operative has testified in court that Nnamdi Kanu, leader of the Indigenous People of Biafra (IPOB), expressed his desire for parts of Kogi and Benue States to be included in the Biafra secessionist territory.
The DSS operative, identified in court only as BBB, stated that Kanu made this assertion during the recording of his statement. BBB was the second prosecution witness to testify against Kanu at the Federal High Court in Abuja, presided over by Justice James Omotosho.
Led in evidence by prosecuting counsel Adegboyega Awomolo, BBB identified a compact disc as containing the recording of his interaction with the IPOB leader. Awomolo subsequently sought to tender the disc, a letter from the Attorney General of the Federation (AGF), and a certificate of compliance as evidence.
However, Kanu’s defense lawyer, Kanu Agabi, objected to the admissibility of these items, arguing that the defense had not been served with the AGF letter and the video recording. Agabi emphasized the defendant’s right to receive all documents and materials the prosecution intends to use in the case.
Awomolo stated his readiness to provide the defense with all necessary documents and materials.
In his ruling, Justice James Omotosho upheld the defense’s argument, asserting that they were entitled to all materials the prosecution planned to rely upon. He ordered the prosecution, in accordance with Section 36 of the Constitution, to serve the defendant with all facilities, including documents, intended for use in the prosecution.
Following an application by Awomolo, Justice Omotosho adjourned the case until May 7 to allow the prosecution to serve the defense with the required documents and for the second prosecution witness to continue his testimony.
