The Federal High Court in Abuja has dismissed a suit seeking to prevent the appointment of Chukwuemeka Tony Ubani, Director of Enforcement at the FCT High Court, as a judge.
Justice Inyang Ekwo, who presided over the case, dismissed the suit on Thursday after counsel to the defendants, Akinlolu Kehinde, informed the court that the plaintiff, Bizplus Consulting Services Ltd, had filed a notice of discontinuance.
The suit had sought to restrain the Judicial Service Committee of the Federal Capital Territory (FCT) and the National Judicial Council (NJC) from considering Ubani for appointment to the bench.
However, following the notice of discontinuance filed by the plaintiff, the court proceeded to dismiss the case.
The development effectively brings the legal challenge against the consideration of Ubani’s appointment to an end at the Federal High Court.
It remains unclear from the court proceedings whether the relevant judicial authorities have concluded the process of considering his appointment.
