An investigation has raised questions over whether the Nigerian Upstream Petroleum Regulatory Commission (NUPRC) is fully meeting its legal responsibilities to enforce the country’s laws on gas flaring and curb methane emissions.

The investigation examined the commission’s regulatory responsibilities, particularly its duty to enforce Nigeria’s anti-gas-flaring framework and ensure that oil and gas operators comply with environmental requirements.

Gas flaring — the burning of natural gas produced alongside crude oil — has remained a longstanding environmental concern in Nigeria, contributing to greenhouse gas emissions and air pollution. Methane, a major component of natural gas, is also a potent greenhouse gas when released into the atmosphere.

The findings therefore put the spotlight on the effectiveness of NUPRC’s enforcement mechanisms, including its oversight of oil and gas companies and the measures taken to ensure compliance with regulations designed to reduce routine gas flaring and methane emissions.

The investigation seeks to establish whether the regulator has fulfilled the obligations assigned to it under Nigerian law, while also examining potential gaps between regulatory requirements and their implementation in the oil-producing sector.
